Online orders

These Terms and Conditions should be read by you carefully as they set out the Terms and Conditions under which Grape Passions Limited ("Grape Passions") agrees to trade with you.

Age restriction

1. We will not sell alcohol to anyone under the age of 18.

2. If you are buying a gift the intended recipient must also be over 18.

3. By placing an order you warrant to us that you are over 18 and are not purchasing on behalf of a child under 18 or intending to supply alcohol to a child under 18.

4. We reserve the right at our discretion not to accept your order.

Delivery

Gifts and personalised champagne orders will be delivered within the next 2 working days if ordered before midday. Alternatively deliveries can be made on a later date if requested by the purchaser.

We aim to dispatch all goods within 10 days of receipt of order, but we cannot be liable for late delivery or non delivery owing to any circumstance beyond our reasonable control (including the delay, act or omission of a third party carrier) and delivery of any goods shall be suspended for as long as such circumstance lasts. We will always try to notify you of any delay.

Delivery times may be affected if there are stock availability problems or other unfortunate circumstances. In this instance we will always try to notify you of any delays.

We use an independent carrier to deliver your order. The carrier will leave a calling card if there is nobody aged 18 years or over available to accept the delivery, and the customer should contact the carrier to arrange redelivery. In these circumstances if we have to return to deliver goods a further delivery charge may become payable.

Delivery charges stated are for mainland UK. Orders for delivery to addresses outside of this area, e.g Isle of Man, Isle of Wight, Northern Ireland, Scottish Islands, attract additional delivery charges, please see details on the website or contact us at enquiries@grapepassions.co.uk for further information on these charges.

Deliveries will be made between 0830 – 1700, additional charges will be made for Saturday deliveries or deliveries by a specified time. Please see website for details of these charges or contact us at enquiries@grapepassions.co.uk

Availability and Substitution

If we are unable to supply a particular wine we will notify you. If an advertised vintage is no longer available, we may deliver to you an alternative vintage by way of substitution. Should you not be satisfied, you may return the goods (see Returned Goods below) your statutory rights are unaffected.

Formation of Contract

Our advertisement of goods is an invitation to treat and your order is an offer to buy. We use third party software in this site and nothing that you see on screen will amount to an acceptance of your offer until we dispatch your order to you, but until that point, we may at our sole discretion decline to supply your order. Upon dispatch of your goods, a contract will exist between us and payment will be taken for the goods.

Claims for Damaged Goods

Upon receipt of your order, the condition of the goods should be carefully inspected.

Any breakages or shortages must be notified to the carrier at the time of delivery. Grape Passions will not accept any claims for breakages or shortages unless they are stated on the carriers documentation at the time of delivery.

It remains the responsibility of the customer to notify Grape Passions of any damages or shortages within 7 days of delivery, contact us by email sales@grapepassions.co.uk or telephone: 01621 892381

Grape Passions will make arrangements with the carrier for the return of any faulty or damaged goods

Grape Passions only liability shall be at its sole option as soon as reasonably practicable to make good any shortages, or to refund to the buyer the purchase price paid for the goods.

Nothing in these terms shall affect the purchaser's statutory rights nor shall they limit or exclude Grape Passion's liability for death or personal injury resulting from its negligence nor affect the consumer's rights under the Consumer Protection Act 1987.

Prices & Payment

All prices are inclusive of VAT, unless otherwise stated

Promotional offers and prices are as stated & are subject to availability.

Delivery charges are additional and are as detailed at the time of your order

Purchases can be paid for online using any of the following: Mastercard, Solo, Visa Delta, Visa Electron and Maestro/Switch

All online payments are processed through WorldPay.com

All card holders are subject to validation checks and authorisation by the card issuer. We will not deliver any goods prior to these checks and authorisations being completed. If your card issuer refuses to issue authorisation for payment to us, we cannot accept your order, and will not be liable for any delay or non delivery of goods.

Grape Passions also accepts payment by cheque. Such orders will only be dispatched once the cheque has been received and cleared for payment.

Returned Goods

If we have substituted goods and you do not wish to purchase them, please telephone us upon receipt, on 01621 892381 or contact us by email sales@grapepassions.co.uk and we will arrange for the goods to be collected from you. Upon the goods being returned to us in good and saleable condition we will credit your card with the cost of the goods and any delivery charge.

Order Cancellation

If you are a private individual not buying goods in connection with your business you may have a right to cancel your order as provided for by the Consumer Protection (Distant Selling) Regulations 2000. Please note that you may not cancel an order for personalised goods.

Your right to cancel starts from the day the order is accepted by Grape Passions, and ends on the expiry of 7 working days after your delivery has been received. This is in accordance with the Consumer Protection (Distance Selling) Regulation 2000.

The customer will be liable for the initial delivery cost and the cost of returning the goods to Grape Passions Ltd.

The goods must be returned unopened and undamaged.

To cancel your order email us sales@grapepassions.co.uk and you will be given a reference number and instructions on how to arrange the return of your goods.

The reference number must be clearly displayed on your returned order. Orders returned without first obtaining a reference number will not be accepted for refund.

All credits will be issued within 30 days of the cancellation, provided the goods have been returned within that period.

Orders can not be cancelled for the supply of goods made to the consumer's specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly

These Terms and Conditions do not affect your statutory rights as a consumer

All data is collected lawfully and maintained in accordance with the Data Protection Act 1998. You have a right to access the personal data that is held about you. When contacting us, please provide your full name, postal address, and a cheque for £10.00 made payable to Grape Passions Ltd.

What information do we collect

We collect information when you fill in any registration form and every time you email or provide us with any details. We maintain records of your purchases and any information you may provide when providing us with feedback or completing customer satisfaction surveys. We also retain details of credit/debit cards used by you when making purchases. If you visit our website, we automatically collect information. Information collected in this way is only used in aggregate form, to help us improve our service.

How do we use it ?

The information collected from you will be held and used by Grape Passions in accordance with the provisions of the Data Protection Act 1998 for the purposes of administration, statistical and business data analysis and marketing.

We will never pass your personal information to anyone else except for a successor in title to our business and third party data processors contracted to us to analyse our customer data. We would like to use your information to send you offers and news about the company and our products and services and to keep you up to date with all our latest offers. Overseas Customers

If you do not live in the United Kingdom, local law as to the sale of alcohol may differ. If you are accessing this site from a location outside the United Kingdom you are responsible for compliance with local laws. You should also be aware that sales to customers outside the European Union may attract Customs Duties on the value of the goods which will be in addition to the price and delivery charges you have paid to Grape Passions. Please be aware that it is your responsibility to pay any Customs Duty payable upon the importation of the goods ordered, into your home country. Should you fail to pay any applicable duty, you agree that the goods will still have been sold to you and you agree and acknowledge that Grape Passions should be entitled to retain the sale price of the goods and the delivery charges debited to your payment card.

Third Party Rights

A person who is not a party to any contract entered into with you shall have no right under the Contract (Rights of Third Parties Act) 1999 to enforce any term of the contract but this shall not affect any right or remedy of a third party which exists or is available otherwise.

Law

The law applicable to all orders accepted by Grape Passions is the law of England and Wales and you agree that all transactions undertaken by you with Grape Passions will be governed by the laws of England and Wales and will be settled only by the English Courts. In the event of dispute, you agree not to commence proceedings in any jurisdiction other than England and Wales.
